Your privacy and trust are very important for VACA IP, S.C. (hereinafter referred to as VACA); therefore, we want to be assure that our clients are aware of the actions adopted by means of our Specialized Unit, responsible for keeping the privacy, integrity, treatment and protection of your Personal Data pursuant to the provisions of the Federal Law of Personal Data Protection in Possession of Individuals (LFPDPPP), its Regulation, Guidelines and other applicable rules and regulations.
IDENTITY AND DOMICILE OF THE RESPONSIBLE PARTY.
VACA IP, S.C. (VACA) with domicile at Bosque de Duraznos 69, Torre A, PH 1202, Bosques de las Lomas, 11700, Mexico City, México, is responsible for the use and protection of your personal data.
PERSONAL DATA COLLECTED BY OUR FIRM.
Personal Data that VACA may collect is only data strictly necessary for appropriate rendering of the legal services we offer. Personal data we may collect correspond to the following characteristics.
ID data: full name, private domicile, residence, date and/or place of birth, nationality, Sole Population Code Registry (CURP for its initials in Spanish), marital status, autograph and/or electronic signature, official ID, military service card, age.
Contact data: Information enabling to have contact with its owner: domicile, e-mail address, telephone number (local and/or mobile), fax.
Labor data: Position, job’s domicile, institutional e-mail address, labor references, entry and last day of employment, salary.
Academic data: profession, education background, degree, professional license number, certificates.
Tax data: Federal Taxpayers Registry (Tax ID), fiscal domicile, fiscal ID number abroad.
Financial data: banking accounts information, properties, rights, obligations subject to economic assessment, personal property and real estate property, tax information, credit history, income and expenses, insurance, retirement funds, bonds, credit card number, social security number.
Data required to comply with the Federal Law for Prevention and Identification of Operations with Unlawful Origin Resources and if applicable, corresponding notices, that may be in addition to the data stated in the aforementioned categories: activity, profession, position, documents to evidence your legal stay in the country, if a foreigner; likewise, we may request simple copy prior comparison of your official ID in force and domicile receipt.
Likewise, it is possible we request information from a company to comply with the provisions of such Law, such as corporate name, incorporation date, nationality, tax domicile, activity, corporate purpose, Tax ID, articles (including Articles of Incorporation), official transcripts, powers-of-attorney, public instruments and books and all other above listed data applicable to individuals but due to his/her position and/or capacity as representatives, attorneys-in-fact, shareholders and/or directors of a corporation.
WE DO NOT COLLECT OR MANAGE SENSITIVE OR PERSONAL DATA.
It is important to highlight that VACA DOES NOT collect or manage by any means whatsoever information that may disclose racial or ethnics aspects, genetic information, former, current and future health condition, religion, philosophy and moral beliefs, union affiliation, political opinions or sexual orientation.
PURPOSE OF MANAGEMENT.
Personal data we collect from You will be used for the following purposes divided into primary and secondary purposes:
A. PRIMARY PURPOSES. They are necessary for the legal service you contract from us in our different specialization areas; or else, according to the professional relation we have with you:
Provide legal counseling in our different specialization areas.
Render legal services.
Follow up different proceedings or judicial and administrative proceedings.
Prepare your file.
Billing and Collection Purposes.
Due fulfillment of VACA obligations when Vulnerable Activities are executed, as defined by the provisions of the Federal Law for Prevention and Identification of Operations with Unlawful Origin Resources and therefore, prepare the corresponding file and as applicable, notify the corresponding authorities, as applicable.
Execution of any supplementary or ancillary activity necessary for the rendering of the legal services contracted in your favor.
B. SECONDARY PURPOSES. We will additionally use your personal information for the following secondary purposes enabling and facilitating us to provide you with better service:
Provide related information regarding additional, supplementary, ancillary and related services offered by our firm.
For marketing, advertisement and/or commercial forecasting purposes related to the services offered by the corporation.
Make consultations, investigations and revisions in connection to your complaints or claims or proceed request to enforce ARCO rights.
Your personal data will be kept during the time your commercial relation with us is in force and for a term of 5 years after expiration or termination both for primary purposes and for secondary purposes; or in advance if there is a cancellation request from you according to the proceeding to enforce ARCO rights stated herein below.
PROCEEDINGS OF OWNER TO DENY AUTHORIZATION FOR SECONDARY PURPOSES.
If you do not wish your personal data is used for secondary purposes, you may send an e-mail to our e-mail address contact@vaca-ip.mx as from now stating the above to take the corresponding notes. If you do not express your denial for such purposes in a term of 5 business days as from collection of your personal data, we will understand you have granted us with your implied authorization.
Denial of authorization to use your personal data for secondary purposes cannot be grounds to deny the services requested or contracted by us.
PERSONAL DATA TRANSFER.
Provided the management of your Personal Data is necessary for the aforementioned primary purposes stated herein and mainly to comply with the rendering of the hired services, there is the possibility that VACA needs to transfer it to third parties inside and outside the country to federal, local and/or municipal authorities, foreign authorities and to third parties such as law firms and intermediaries acting as our agents to proceed the legal services VACA renders to you; all of the aforementioned parties will assume the same obligations regarding management and protection of your personal data pursuant to the provisions hereof.
We do not legally require the express authorization from the owner of data for the above-stated purposes; however, it is worth mentioning that if you do not wish your personal data is transferred, you may send an e-mail to our e-mail address contact@vaca-ip.mx, as from now, stating the above to take the corresponding notes. If you do not express your denial to such transfer in a term of 5 business days as from collection of your personal data, we will understand you have granted us with your authorization, accordingly.
REMEDIES AND PROCEEDING TO ENFORCE ARCO RIGHTS AND REVOCATION OF YOUR AUTHORIZATION.
You have the right to be aware the personal data we have from you, purpose thereof and conditions thereof (Access). Likewise, it is your right to request the correction of your personal information if it is not updated, it is inaccurate or incomplete (Rectification); that we delete your file from our database or your file if you consider your data is not used according to the principles, duties and obligations provided in the rules and regulations (Cancellation); and to oppose to the use of your personal data for specific purposes (Opposition). These rights are denominated ARCO rights for its initials.
Likewise, you may revoke at all times the authorization you have granted and necessary for the management of your data and to limit the use or disclosure thereof.
These rights may be enforced at any time by means of our Unit Specialized in Attention to the Public at the address and contact data indicated herein below, where all your doubts related to the applicable proceeding for such purpose shall be addressed and made clear.

Request must be entered in a simple brief writ: 1) accurately describing the ARCO rights intended to be enforced; 2) indicating the personal data on which it is intended to enforce the above-stated rights; it is also important to 3) provide any element or document facilitating the location of the personal data regarding which the ARCO are intended to be enforced. Likewise, it is very important 4) to duly evidence your identity as owner of the rights; or else, to provide documents evidencing your legal representation; it may be an official ID and/or a simple power-of-attorney; 5) provide address to hear and receive notifications and 6) an e-mail address to response the request, such means is the most preferably means for such purpose.
Maximum response time to your request is 20 days as from the date on which the request was received to report on the admissibility of such request by means of the e-mail address provided to us to enter your request.
It is worth mentioning that the enforcement of your ARCO rights; or else, your right to revoke your authorization is free of charge, VACA may only request the payment for supported mailing or reproduction expenses of the information requested by you, the delivery thereof may be upon request in electronic means to avoid expenses.
Likewise, you are notified hereby that there are some cases in which we may not immediately respond your request or refrain from using your data since it is possible that due to a contractual and/or legal obligation we require to continue managing your personal data. You must also consider that in certain cases, revocation of your authorization will imply we cannot continue with the commercial relation between VACA and you.
On the other hand, you may decide to use alternative remedies to limit the use or disclosure of your personal data other than the enforcement of the ARCO rights and revocation of your authorization by means of registration in our exclusion list for publication so that your personal data is not managed for marketing, advertisement and/or commercial forecasting purposes on our side. Likewise, if you consider that your right to protection of your personal data has been infringed by an action or omission on our side, you may file your claim or complaint with the National Institute of Transparency, Access to Information and Protection of Personal Data (INAI for its initials in Spanish). SECURITY MEASURES.
VACA has adopted and keeps the security, administrative, technological and physical necessary actions and make them available to you to protect your personal data against damage, loss, alteration, destruction or unauthorized use, access or management. If a violation of our security occurs significantly affecting your rights, you will be immediately informed to take the corresponding actions for the defense of your rights.
CHANGES TO THE PRIVACY NOTICE.
This privacy notice may suffer modifications, changes or updating resulting from new legal requirements; from our own needs due to the services we render; from our privacy practice or due to other reasons. In any case such changes will be notified in our web site.
Finally, please note we do not use cookies, web beacons or any other similar technology in our web page or in any of our platforms.
